What are Loan Penalty Charges
Loan providers will generally charge you for a late or missed payment on your loan account by way of a penalty charge. This penalty charge has tended to be a blanket charge applied to your loan account no matter what the reason for the late or missed payment was, and regardless of the balance on your loan account or the amount of the late or missed payment.
Unfair Loan Penalty Charges
The Unfair Terms in Consumer Contract Regulations state that banks and other finance providers should only ‘impose charges in proportion to their costs’. This means that any charge they have imposed on you for late or missed payment on your loan account should be equivalent to what the cost has been to them.
The charge imposed on you should not be a punishment, nor should your loan provider be making a profit out of these charges. Nevertheless, many banks and loan providers have unfairly charged their customers much more than what it has cost them for a late or missed payment on their loan account.
This means that you can make a claim to have your unfair loan penalty charges returned to you. It does not matter if you loan account is now repaid and closed, you can still make a claim as long as the charges you incurred on the loan happened in the last 6 years.
