Can I claim against any Credit Agreement?
As long as the amount is less than £25,000 and above £2,000 (We only deal with claims over £2000) then we can pursue a claim against any Credit Agreement governed by the Consumer Credit Act.
What types of Credit Agreements could I claim against?
We can audit the following types of credit agreement to see if you have a claim: (providing that the claim is over £2,000) Personal Loans, Credit Cards, Hire Purchase Agreements, Car Finance, Mortgage Loans, Secured Loans and Payment Protection Insurance.Time limits apply on each type of agreement so if you think you may have a claim, please apply online and we will be glad to discuss this with you.
Are you a regulated Claims Management Company?
Yes, we are. ClaimForRefunds Ltd, trading as Claimback Toda yis regulated by the Ministry of Justice. Our authorisation number is CRM18156.
I don't think I have the paperwork anymore, can you still help me?
Yes we can. We can obtain all of the paperwork required to make a claim on your behalf. All you need to do is give us as much information as possible to enable our experienced claims handlers to assess your claim. If you do have any of the original paperwork please include this when you return your claim pack. Time limits apply though - so don't delay!
How long will the process take?
It is impossible to give you an exact time period as the length of time before a settlement can be reached can vary widely. Also, lenders will try and take the maximum time possible before offering any settlement. However, what you can be assured of is that we and your appointed solicitor will work tirelessly on your behalf to achieve settlement in the shortest time possible. We receive some settlement offer as soon as 3-4 weeks after submitting your claim. We cannot promise you this will be the case with your claim, as often we are in the hands of your lender. But we will do our best!
Other companies charge upfront review fees. Do You?
NO! We strongly advise you do not pay an upfront review fee to any company. We have seen competitors trying to charge between £200 and £600 to review each loan agreement. We are a financially solvent company that does not need to and does not see why a client should pay a large upfront review fee. We are on your side at all times during the process. Who is Claimback Today and am I getting the best advice?
We have much experience with claims management activities and take our duties to our clients very seriously. You will benefit from a combination of specialist legal knowledge and the use of solicitors and barristers that are experts in their field.
Can I make the claim myself?
Yes you can try to do so. Advice is available from the Financial Ombudsman or you could seek assistance from organisations such as the Citizens Advice Bureau. However, it can be a drawn out process and you may not wish to bear the burden of court fees. Claim4Refunds feel access to expert legal advice is important in these matters.
Does it matter if I am in an IVA or on a debt management plan?
No. We can still assist you in making a claim.
Will I have to discuss this with the Creditor?
No. Once you have authorised us to deal with your complaint you do not need to inform your creditors. They are also not allowed to pressurise or hassle you in relation to your complaint.
Will I be responsible for any costs to the nominated solicitor?
No, if unsuccessful you will not have to pay any costs incurred. Arrangements are in place to ensure the costs are covered. If successful the nominated solicitor will seek the costs from the other side.
What happens when I win?
If you win, our fee is payable of 29% (+VAT) on the total amount of money written off or recovered on a credit agreement. Should we recover PPI premiums you have paid then our fee will be 29% (+VAT) of the total recovered. This will be subtracted from the total amount you receive from the creditor. This includes all legal advice and representation. Please see terms and conditions for full information.
What if I lose?
If you lose a case the maximum amount of money you would pay is our minimum fee of £99 per claim. We do not charge this fee for any claim where a Payment Protection Insurance policy is evident on an agreement. Please see terms conditions for full details (8.4.1 and 8.4.2). You will not pay for legal advice if you lose as this is offered on a 'no win no fee basis'. We believe our offering is both ethical and reasonable. Many of our competitors charge between £200 and £600 per audit upfront with no guarantees of success - We strongly advise you not to do business with companies who operate in this manner. If I send my credit agreements for audit by your solicitors and they do not believe I have a claim, would I have to pay C4R a fee?
Yes, this is explained in our terms and conditions (8.4.1 and 8.4.2). The fee would be £99 and charged after a case is closed after a full review by our solicitors. We will review any agreement where a Payment Protection Insurance (PPI) policy is evident on a 'no win no fee' basis. The majority of agreements taken out in the past 12 years do have PPI on them. If we win, we charge a fee of 29% (+VAT) on any monies recovered or written off by the lender. This fee can be paid at once or, as we appreciate many of our clients may like to do, in affordable monthly instalments. If you wish to pay in instalments, this is subject to our agreement and evidence of financial hardship and interest will be applied at the rate of 8.5% per annum. We are working to be ethical in all stages of our business and keep costs to a minimum for our valued clients.
